Leasing

The leasing group offers a broad range of services for landlords and tenants. We are at the forefront of change keeping abreast of legislation and advising clients. Our experience extends to all States and Territories in Australia and New Zealand.

Landlords

Our extensive service in acting for landlords includes preparing and finalising:

  • offers to lease
  • agreements to lease
  • leases
  • lessor disclosure statements
  • licences (eg ATM, car parks, seating areas, storage)
  • deeds of covenant consents
  • rights of entry variations
  • breach notices.

The group also prepares master lease documentation for real estate and other industry clients.

We also draft complex lease arrangements and provide specific advice on the rights and obligations under lease transactions.

We provide significant due diligence support on leases and related documents in the acquisition or disposal of industrial and commercial buildings and shopping centres.

Our experience also extends to defending claims under the Retail Shop Leases Act (QLD).

Tenants

Herbert Geer acts for numerous tenants in:

  • advising on and negotiating all lease documentation and in several instances a national suite of standard amendments with landlords
  • town planning advice
  • negotiating market and other rent reviews
  • securing adequate tenure beyond the usual short lease term
  • negotiating options to renew
  • preparing subleases and licences
  • negotiating surrenders and transfers and variations.

Our tenants are corporate and institutional clients, small business and family owned businesses. We examine the individual requirements of our clients and provide easy to understand practical advice on just what a lease is.

Our experience also extends to prosecuting claims under Retail Shop Leases Act (QLD).
