Herbert Geer acts for a number of Australia’s leading ISPs. A number of them have established streaming services for music and visual content as well as IPTV services. We assist these clients by drafting and negotiating agreements under which they are licensed to use the content. This involves a detailed understanding of the complex rights matrix that exists in this area and a thorough knowledge of the collecting societies and rights holders that are critical to the success of our clients’ business models.
We also assist our ISP clients to understand their rights under the Copyright Act, including the operation of the ‘safe harbour’ provisions. Currently, we are acting for iiNet, one of Australia’s largest ISPs, in ground breaking copyright litigation.
